In California criminal law, “Individually identifiable information” is a term defined by statute rather than by its everyday meaning. Its statutory definition — quoted verbatim below — controls how the term is applied throughout the California criminal code.
What does “Individually identifiable information” mean in California criminal law?
“Individually identifiable information” means any information identifying an individual or the individual’s use of any service provided by a satellite or cable system other than the mere fact that the individual is a satellite or cable television subscriber. “Individually identifiable information” shall not include anonymous, aggregate, or any other information that does not identify an individual subscriber of a video provider service. (Cal. Penal Code § 637.5)
