(a) It is unlawful for any person to advertise, or to facilitate the advertisement of, nonparimutuel wagering on horse races. (b) Violation of this section is an infraction punishable by a fine of five hundred dollars ($500). A second conviction for a violation of this section is a misdemeanor punishable by a fine of up to ten thousand dollars ($10,000).
