A violation of subdivision (b) or (c) of Section 21367 is an infraction, except as follows: (a) A willful violation is a misdemeanor. (b) A willful violation committed in a manner exhibiting a wanton disregard for the safety of persons is a misdemeanor punishable by imprisonment in the county jail for not more than one year.
