(a) Except as provided by Subsection (b), an offense involving the misapplication of property held as a fiduciary or property of a financial institution in one county and the removal of that property to another county may be prosecuted in any county: (1) in which the property was misapplied; (2) through or into which the property was removed; or (3) in which the fiduciary was appointed to serve, if applicable. (b) An offense related to misapplication of construction trust funds under Chapter 162 , Property Code, must be prosecuted in the county in which the construction project is located.
