(a) A magistrate may require as a condition of release on bail or bond of a defendant that the defendant provide to a local law enforcement agency one or more specimens for the purpose of creating a DNA record under Subchapter G , Chapter 411 , Government Code. (b) A magistrate shall require as a condition of release on bail or bond of a defendant described by Section 411.1471 (a), Government Code, that the defendant provide to a local law enforcement agency one or more specimens for the purpose of creating a DNA record under Subchapter G , Chapter 411 , Government Code.
