(a) This article applies only to: (1) conviction or deferred adjudication community supervision granted on the basis of: (A) an offense for which a conviction or grant of deferred adjudication community supervision requires the defendant to register as a sex offender under Chapter 62 ; (B) an offense under Section 21.12 or 43.24 , Penal Code; (C) a felony offense under Chapter 43 , Penal Code; (D) a felony offense involving school property; or (E) an offense under the laws of another state or federal law that is equivalent to an offense under Paragraph (A), (B), (C), or (D); or (2) conviction of: (A) a felony offense under Title 5, Penal Code; or (B) an offense under the laws of another state or federal law that is equivalent to an offense under Paragraph (A). (b) Not later than the fifth day after the date a person who holds a certificate issued under Subchapter B , Chapter 21 , Education Code, is convicted or granted deferred adjudication on the basis of an offense, the clerk of the court in which the conviction or deferred adjudication is entered shall provide to the State Board for Educator Certification written notice of the person's conviction or deferred adjudication, including the offense on which the conviction or deferred adjudication was based. (c) Not later than the fifth day after the date a person who is employed by a private school is convicted or granted deferred adjudication on the basis of an offense, the clerk of the court in which the conviction or deferred adjudication is entered shall provide to the chief administrative officer of the private school at which the person is employed written notice of the person's conviction or deferred adjudication, including the offense on which the conviction or deferred adjudication was based. (d) In this article, "private school" has the meaning assigned by Section 5.001 , Education Code.
