Tex. Health & Safety Code § 481.131Primary source, current through the 89th Legislature, 2nd Called Session (2025)
(a) A person commits an offense if the person intentionally or knowingly: (1) converts to the person's own use or benefit a controlled substance property or plant seized under Section 481.152 or 481.153 ; or (2) diverts to the unlawful use or benefit of another person a controlled substance property or plant seized under Section 481.152 or 481.153 . (b) An offense under this section is a state jail felony.
