(1) As used in this section, "finance officer" means the same as that term is defined in Section 17-66-101. (2) Whenever a judge of a court of record of this state issues a certificate under the provisions of this chapter to obtain the attendance of a witness for the prosecution from outside the state in a criminal prosecution or grand jury investigation commenced or about to commence, the judge shall designate a suitable peace officer of this state to: (2)(a) present the certificate to the proper officer or tribunal of the state wherein the witness is found; and (2)(b) tender to the witness the witness's per diem and mileage fees. (3) The peace officer designated as described in Subsection (2) shall exhibit the certificate to the county finance officer of the county in which the criminal proceeding is pending and the finance officer shall draw a warrant upon the county treasurer in favor of the peace officer in the amount to be tendered to the witness. (4) The peace officer shall be liable upon the peace officer's official bond for the proper disposition of the money received under Subsection (3). (5) In all cases in which the peace officer is required to travel in order to present the certificate and tender fees, the peace officer's actual and necessary traveling expenses shall be paid out of the fund from which witnesses for the prosecution in the criminal proceeding are paid.
